ComPaSS Website Terms & Conditions (v1b)

INTRODUCTION

These terms and conditions govern your use of the ComPaSS Website.

In using the ComPaSS Website you agree to abide by all applicable laws, regulations and codes of conduct and ensure that any content uploaded or distributed or stored by you does not infringe the rights of others.

You will be required at the point of registration, to check the box marked ‘I accept’ (terms and conditions) before being able to access the member area of the site.

By accepting these terms and conditions of use you are responsible for ensuring that all content you add to the website does not contain PERSONAL INFORMATION which breaches:

THE DATA PROTECTION ACT

The Data Protection Act gives individuals the right to know what information is held about them. It provides a framework to ensure that personal information is handled properly.

Anyone who processes PERSONAL INFORMATION must comply with eight principles, which make sure that personal information is:

  • Fairly and lawfully processed
  • Processed for limited purposes
  • Adequate, relevant and not excessive
  • Accurate and up to date
  • Not kept for longer than is necessary
  • Processed in line with your rights
  • Secure
  • Not transferred to other countries without adequate protection

You must also ensure that ComPaSS Website use is in compliance with your own organisational guidance, direction and practice and should consult your own data management department if you have any doubts.

DEFINING PERSONAL INFORMATION

Is the information about a living, identifiable individual? For example a name accompanied by other information about the individual such as address, age, telephone number, information regarding his/her crime status, involvement in crime events. It can be an expression of an opinion about the individual or an indication of the intentions of any person towards that individual. The data can be biographical even when a combination of different data sources is needed to identify the individual e.g. where individuals are identified only by numbers in a database but a list of to whom the numbers correspond is maintained elsewhere.

Yes: Go to next question  No: The information is not personal data and therefore not subject to the Data Protection Act.

Does the information "relate to" a living, identifiable individual? Is it about them? Just because a document or file title contains somebody’s name does not always mean that it is about him. A problem solving template including, ‘Home visits conducted by PCSO Smith’, which addresses a broader problem, is not about PCSO Smith. Likewise, problem solving partners listed will not be ‘personal data’ simply because the person contributed to broader problem outcomes. However, if the problem solving discussed an individual or included information relating to that individual; For example (PCSO Smith organised the visit schedule from home at 35 Windy Hollow and suffering from Avian Flu), then the inclusion of the individual’s details plus additional information will constitute personal data.

Yes: Data Protection Act applies and you will not include the personal information on the ComPaSS Website  No: The information is not personal data and therefore not subject to the Data Protection Act.

Sensitive Personal Data

Some personal data is classed as sensitive personal data. This type of data is subject to further regulations under the Data Protection Act and can only be processed under certain circumstances.

Personal data becomes sensitive if it includes any of the following types of information about an identifiable, living individual:

  • racial or ethnic origin;
  • political opinions;
  • religious beliefs;
  • trade union membership;
  • physical or mental health;
  • sexual life;
  • commission of offences or alleged offences.

ComPaSS products are created specifically for responsible authorities and recognised voluntary sector practitioners and for a particular purpose and are not generally intended to enter the public domain.

We may disable your membership ID and password if you breach any of the policies or terms governing your use of our website.

We may revise these terms and conditions from time-to-time. Please check this page regularly to ensure you are familiar with the current version.

ENTIRE AGREEMENT

These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of the ComPaSS website, and supersede all previous agreements in respect of your use of the ComPaSS website.

LAW AND JURISDICTION

This notice will be governed by and construed in accordance with English law, and any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of England.

ComPaSS is registered with the Information Commissioner’s Office as a data controller for the purposes of the Data Protection Act 1998. The registration number is Z9781171 and expires on 18 February 2009.
